Timesharing Modification
Parenting plans and time-sharing/custody agreements may be modified if there has been a substantial change in circumstances which was not anticipated at the time of the Final Judgment. A change in circumstances must be of the nature that would make a change in time-sharing necessary for the best interest of the children. Depending on the extent of the change, it is possible that child support guidelines will have to be recalculated based on the change in the number of overnights and the parties' respective incomes.
Child Support Modification
Modifications of child support will be granted when there is a substantial change in circumstances justifying an increase or decrease in child support. This happens when one party’s income changes or they become unemployed. Modification can be secured because a child is no longer needing daycare or child care or in older cases where one child has emancipated and the judgment did not contemplate the recalculation of child support. Modifications of child support are often the result of a modification of timesharing.
Alimony Modifications
In some cases, the Parties may agree to modify alimony. These cases can be resolved relatively quickly with a modification agreement and court order adopting the modification. When the parties do not agree, the party seeking the modification will file a petition for modification of alimony which will need to be served upon the other party showing that a substantial change in circumstance has occurred that justifies the requested modification. Some substantial changes in circumstances include: Changes in Income, Retirement, Remarriage, Co-habitation/Supportive Relationships, etc.
